Win A Van Prize Draw
These are the terms and conditions (“Rules”) that apply to the Win a Van prize draw promotion (“Prize Draw”). Entry into the Prize Draw is subject to these Rules and the Howdens Privacy Notice at www.howdens.com/legal-information/privacy-policy/. In particular, please see the entry exclusions in Rules 4-7, and the limitations of liability in Rule 29.
About the Prize Draw
1. The promoter of this Prize Draw is Howden Joinery Limited of 40 Portman Square, London W1H 6LT (“Promoter”).
2. The Prize Draw opens for entry at 7:00 am on Monday 4 September 2023 and closes at 4:59 pm on Saturday 28 October 2023 (“Prize Draw Entry Period”).
Eligible Entrants and Exclusions
3. The Prize Draw is only open to current Howdens trade account holders registered and located in England, Scotland, Wales, and Northern Ireland only, excluding those listed in Rules 4-7 below (“Eligible Entrant”). For the avoidance of doubt, trade account holders in the Isle of Man and Republic of Ireland are excluded from the Prize Draw.
4. The Prize Draw is not open to any Howdens’ trade account that is held by or in the name of a Council, Trust, School, Hospital or Housing Association, regardless of whether or not they make a Qualifying Purchase. Trade accounts held by or in the name of a Council, Trust, School, Hospital or Housing Association are not Eligible Entrants.
5. Employees, staff and other individuals who represent a Howdens trade account holder (“Representatives”) are not Eligible Entrants. Where a Representative enters the Prize Draw by making a Qualifying Purchase (see Rule 12 below), they do so on behalf of the person or entity registered as the Howdens trade account holder. Representatives must be at least 18 years old and authorised by the relevant Howdens trade account holder to make a Qualifying Purchase and enter the Prize Draw on behalf of the Howdens trade account holder.
6. Employees (or family members of employees) of the Promoter and any group company of the Promoter, companies associated with the Prize Draw and all affiliates of such companies may not enter.
7. An Eligible Entrant will be excluded from the Prize Draw if, following the end of the Prize Draw Entry Period, the account holder’s trade account payments are not up to date and they have been contacted (whether by phone or in writing) by Howdens’ Litigation team about an overdue balance on their account.
The Prizes
8. The prizes to be won are as follows (each a “Prize” and together, the “Prizes”):
a) 1 x grand prize for the first name drawn, consisting of a 2023 Ford Transit 350 L3 H2 2.0tdci-130ps Base FWD Manual Van in Agate Black with Factory Spare Wheel, Hykee Lock, Rear Parking Sensors, and Fully Plylined. Worth over £38,000, including a minimum of 12 months’ Vehicle Road Tax and £500 towards vehicle insurance (which must be arranged by the winner) (“Grand Prize”), to be drawn at the time specified in Rule 16. a; and
b) 10 x runner up prizes. After the winner of the Grand Prize has been drawn, the next 10 names to be drawn will each win £1,000 trade credit to be applied to your Howdens trade account and used for future purchases made after the Prize Draw Entry Period. As applicable each a “Runner Up Prize”, is to be drawn at the times specified in Rule 16. b.
9. Unless otherwise stated in these terms, all taxes, insurances and/or other expenses incurred in connection with any of the Prizes are the sole responsibility of the Prize winner.
10. All Prizes are non-transferable, non-exchangeable, and non-refundable. There is no cash alternative. The Promoter reserves the right to substitute any Prize (or part of a Prize) with a prize of a similar nature and/or value should any original element of a Prize become unavailable for any reason.
11. Prize details are correct as at the date of publication.
Entering the Prize Draw
12. Eligible Entrants will automatically receive an entry into the Prize Draw when they complete a single transaction with the Promoter during the Prize Draw Entry Period that meets the following criteria (“Qualifying Purchase”):
a. the transaction has a minimum spend of £300 (ex. VAT); and
b. the transaction is for delivery or collection from a Howdens depot in England, Scotland, Wales and Northern Ireland; and
c. the transaction includes the purchase of any Lamona appliance (“Qualifying Goods”).
13. There is no limit on the number of entries in the Prize Draw that can be earned by an Eligible Entrant and it is possible to earn multiple entries into the Prize Draw in a single transaction. For example, if an Eligible Entrant spends £300 (ex. VAT) in a single transaction that includes the purchase of two Qualifying Goods, this would equate to two entries in the Prize Draw; or if an Eligible Entrant spends £1,000 (ex. VAT) in a single transaction that includes the purchase of five Qualifying Goods, this would equate to five entries in the Prize Draw.
14. An entry in the Prize Draw will be invalidated if any goods forming part of the Qualifying Purchase are returned to the Promoter with the result that the number of Qualifying Goods and/or the minimum spend of £300 (ex. VAT) falls below the minimum requirement for an entry.
15. Entry to the Prize Draw is automatic where the Eligible Entrant (see Rules 3-7) completes a Qualifying Purchase. However, Eligible Entrants may opt out of the Prize Draw at any time by notifying the Promoter at winavan@howdens.com including the subject line “Win a Van Prize Draw – Opt Out”.
Winning Prizes
16. Prize winners will be selected at random from all eligible entries as follows:
c) Grand Prize: all eligible entries earned from Qualifying Purchases made no later than 4:59 pm on the last day of the Prize Draw Entry Period will be entered into the draw for the Grand Prize. The draw will take place within seven (7) days of the end of the Prize Draw Entry Period.
d) Runner Up Prizes: all eligible entries earned from Qualifying Purchases made no later than 4:59 pm on the last day of the Prize Draw Entry Period will be entered into draws for the 10 x Runner Up Prize. The draws will take place within seven (7) days of the end of the Prize Draw Entry Period.
For the avoidance of doubt, a winner can only win 1 prize. Once a name has been picked as a winner it will be removed so that winner cannot win another prize.
17. Prize winner(s) will be notified by email and/or telephone within 7 days of the relevant draw date using the contact details registered against their Howdens trade account. Notification will be sent to the person named as the account holder and not necessarily the person who made the Qualifying Purchase.
18. Return of any notification as undeliverable may result in disqualification and selection of an alternate winner. The Promoter will make reasonable efforts to contact the winners but the winner is solely responsible for checking their voicemail and email (including spam and junk folders) for a notification.
19. To claim a Prize, the winner must provide the information requested in the winner’s notification within 7 days of the date of the notification. Claims for Prizes must be made in the manner and within the time specified on the notification. Failure to claim a Prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.
20. All Prizes shall be made available for collection at the winner’s local depot and the winner (or its authorised representative) must attend to collect the Prize in person. The £500 insurance contribution will be made by cheque made payable to the registered Howdens account holder. The time for collection of the Prize(s) will be agreed between the winner and the Promoter. If the Prize is to be collected by an authorised representative of the winner, the winner must provide the name of the relevant authorised representative at the time of claiming the Prize and the authorised representative must provide proof of identity when collecting the Prize.
21. All Prizes must be collected within 90 days of the date the Prize is validly claimed in accordance with Rule 20. Failure to collect a Prize within this time may result in disqualification and selection of an alternate winner.
Privacy
22. The Promoter respects your right to privacy and will only process personal data you provide in accordance with the General Data Protection Regulation, the Data Protection Act 2018, the Privacy and Electronic Communications (EC Directive) Regulations 2003 and other applicable privacy laws for the purpose of administering your participation in this Prize Draw and, if you are a winner, arranging collection of the Prize. 23. The winner may also be required to take part in reasonable further post Prize Draw publicity for the Promoter, which may include filming, photography or other recordings required by the Promoter (or third parties on behalf of the Promoter) for publicity purposes and you agree to take part in any such publicity. For example, when collecting a Prize, the winner may be asked to pose for photographs with a representative of the Promoter when being presented with their Prize. After the winners have been notified of their winning entry and accepted the Prizes, their names and entries, and photos/videos featuring them, may be displayed by the Promoter in social media posts and other print and digital marketing and promotional materials, which will be globally accessible, in perpetuity.
24. By entering this Prize Draw, each entrant acknowledges that if they win a Prize, their surname and county of residence may be disclosed to persons enquiring, where permitted by law. Any entrant may object to their information being made available in this way, or may request that the amount of information made available be reduced, by contacting the Promoter at winavan@howdens.com. In these circumstances, the entrant acknowledges that the Promoter may nevertheless disclose such information in full to the UK Advertising Standards Authority if required to do so. This may happen where, for example, the Promoter is required to demonstrate that a valid award took place. To request disclosure of the winners’ details, enquirers must submit a request by email to winavan@howdens.com no later than 30 days following the end of the Prize Draw Period. Details will only be disclosed (if permitted by law) after all Prizes have been validly claimed.
General
25. Subject to Rule 32, the Promoter’s decision is final and binding, and no correspondence will be entered into regarding the outcome of the Prize Draw.
26. No responsibility will be accepted for incorrect, late, lost, indecipherable or misdirected entries or for any failure of communication resulting from incorrectly supplied information or technical fault of any kind.
27. The Promoter reserves the right to check the validity of any entry and the identity of any entrant or winner, and to refuse/disqualify entry or refuse the giving of any of the Prizes if the Promoter reasonably considers the entry/entrant and/or winner to be in breach of these Rules or applicable law.
28. The Promoter reserves the right at any time in its sole discretion to cancel, modify or supersede the Prize Draw if it believes, in its sole discretion, that the Prize Draw is not capable or is likely not to be capable of being conducted fairly or as specified within these Rules due to events beyond its control (including, without limitation, a virus, a computer bug or unauthorised human intervention or any other cause beyond the reasonable control of the Promoter that could corrupt or affect the administration, security, impartiality or normal course of the Prize Draw).
29. Nothing in these Rules shall limit in any way the Promoter’s liability for death or personal injury caused by its negligence, or for fraud, or any other type of liability which may not be limited or excluded under applicable law. Subject to that, the Promoter shall have no liability to any person under or in connection with these Rules or the Prize Draw, whether in contract, tort (including negligence) or otherwise, for any:
a. loss or damage arising from or in connection with technical problems of any kind (including the unavailability of the Promoter’s websites or apps) which may limit or prevent any person's participation in the Prize Draw;
b. loss or damage arising from or in connection with the allocation or enjoyment of any of the Prizes;
c. loss or damage arising from or in connection with any act or omission of any third party, particularly any third party involved in the provision of services relevant to any of the Prizes; or
d. loss or damage arising from or in connection with events beyond the Promoter's control that may cause the Prize Draw to be disrupted or corrupted or may lead to loss of, or damage to, the winner or to the Prizes in transit thereto; or
e. any loss of profits or revenue, any loss of anticipated savings, any loss of or damage to goodwill or any indirect or consequential loss or damage.
30. The Prize Draw is in no way sponsored, endorsed or administered by any third party, including any Prize provider or any social media platform. All third-party trademarks and other intellectual property rights are hereby acknowledged. By participating in the Prize Draw, entrants are providing their information to the Promoter, not to any third party. To the maximum extent permitted by applicable law, social media platforms and other third parties shall have no liability to any person or company in connection with or arising out of the Prize Draw howsoever caused, including for any costs, expenses, damages and other liabilities.
31. If any of these Rules are found by a court or regulator to be invalid or unenforceable the remaining other provisions shall continue to apply. The Promoter’s failure to enforce any term of these Rules will not constitute a waiver of that provision.
32. The Prize Draw and these Rules shall be governed by the laws of England and Wales. Any disputes arising in connection with the Prize Draw and/or these Rules shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that (i) residents of Scotland may also bring proceedings in Scottish Courts, and (ii) residents of Northern Ireland may also bring proceedings in Northern Irish Courts.
